Terms of Service

These terms apply when you (the business owner, "you") sign up for one of our website plans. By starting a subscription, you agree to these terms, our Refund & Cancellation Policy, our Domain Policy, and our Privacy Policy.

1. What we do

We design, run, and maintain a website for your business, and (on the higher plan) manage your Google Business Profile. These are ongoing design and marketing services that we perform and operate for you. We own and operate the website on our own accounts and systems as part of that service. You don't get a login to, or install, download, or operate, any software; you send us changes and we make them.

2. Plans and prices

• Plans are billed monthly in advance through Stripe, starting the day you sign up, and renew automatically each month until you cancel.
• Prices don't include tax unless we say so. We'll add any tax that applies.
• Premium and extra domains cost our actual cost plus a $15 handling fee (see the Domain Policy). If your included domain's renewal price rises above $20/year, we'll give you at least 30 days' notice and options before it renews, as described in the Domain Policy.
• Work outside the plan (for example, a new section of the site or extra GBP posts) is quoted separately and only done after you approve it.
• If we change prices, we'll email you at least 30 days before the new price applies to your bill. You can cancel before then.

3. Free preview

We may build a free preview of your site before you sign up. You owe nothing for a preview. If you don't sign up, we take it down and delete it as described in our Refund & Cancellation Policy.

4. Cancelling and refunds

• Cancel anytime. No contracts and no cancellation fees. Cancellation takes effect at the end of your current billing period; service continues until then and you won't be charged again.
• First-month guarantee: ask within 14 days of your first payment for a full refund of that payment (less any domain cost already incurred).

5. What you give us, and what you're responsible for

• You'll send us accurate business information (name, phone, hours, services, photos, logos, text) and tell us when it changes.
• You confirm you have the right to let us use everything you send us, and that it doesn't infringe anyone's rights or break the law.
• For GBP management, you'll give us manager access to your profile. You remain the owner of your profile.
• You're responsible for your business's dealings with your own customers, including responding to inquiries we forward to you from your site.
• You won't ask us to publish anything unlawful, misleading, or harmful. We may decline or remove content that we believe is.

6. Ownership — no software license

• Your content stays yours. You own your business name, logo, photos, text, and other material you provide. You give us permission to use it only to perform our services for you, and that permission ends when our services end (apart from the limited records described in our Privacy Policy).
• Your Google Business Profile is yours.
• Domains: the domain we register for your site is registered under our account and is part of the service we operate for you. On cancellation, we'll provide the domain's transfer code for a one-time transfer fee of $50. If you don't transfer it, we keep the domain until its current registration expires, and then it lapses. See the Domain Policy.
• Our systems stay ours. The templates, code, design system, tools, and hosting setup we use to run your site belong to us or our licensors. These services do not grant you any license to, access to, or copy of our software, code, or systems, and you don't receive a software product. What you're paying for is our work operating your website and marketing for you.
• When you cancel, you can ask for an export of your content and the public files of your site as described in the Refund & Cancellation Policy. Third-party items we license (certain fonts, themes, stock photos) aren't included.

7. Our service standards

• We'll do the work with reasonable care and skill and respond to change requests within a reasonable time.
• We work to keep your site online but don't guarantee uninterrupted service, and downtime doesn't earn credits or refunds.
• We don't guarantee any particular search ranking, number of leads, reviews, or sales. Google decides what appears on Google Search and Maps, and may change or limit your profile.
• We rely on third-party providers (including Stripe, Vercel, and Google). We're not responsible for their outages or policy changes, but we'll help you work around them where we reasonably can.

8. Suspension

If you dispute a valid charge with your bank, any chargeback or dispute fees we're charged are passed on to you (see the Refund & Cancellation Policy).

We may suspend your site or GBP work if your payment is overdue past the grace period in our Refund & Cancellation Policy, if you breach these terms, or if your content creates a legal or security risk. We'll tell you why and restore service once the problem is fixed.

9. Disclaimer

Apart from what Section 7 says, our services are provided "as is," and to the extent the law allows, we disclaim implied warranties such as merchantability and fitness for a particular purpose.

10. Limitation of liability

To the extent the law allows: (a) we're not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data; and (b) our total liability for any claim relating to our services is limited to the amount you paid us in the 3 months before the claim arose.

11. Indemnity

You'll cover our reasonable costs if a third party makes a claim against us because of content or information you gave us, or your business's own conduct.

12. Ending these terms

You can end these terms by cancelling. We can end them with 30 days' written notice, or immediately for serious breach or non-payment after suspension. Sections 6, 9, 10, 11, and 13 continue after the terms end.

13. General

• Governing law: Delaware law governs these terms. Disputes will be handled in the state or federal courts located in Delaware.
• Changes: we may update these terms. For changes that matter, we'll email you at least 30 days in advance. Continuing service after that means you accept them.
• Entire agreement: these terms, plus the policies linked above and any quote you approve, are the whole agreement between us.
